Former Georgia Tech Student Files NCAA and ACC Concussion Lawsuit

Raizner Slania filed a lawsuit on behalf of a former Georgia Institute of Technology (Georgia Tech) football player against the National Collegiate Athletic Association (NCAA) and the Atlantic Coast Conference (ACC). The plaintiff alleges the NCAA and ACC have been reckless in safeguarding the health and wellbeing of student athletes.

The plaintiff played football for Georgia Tech as a corner back and on special teams from 1996 to 1999. The plaintiff remembers suffering from a number of concussions while playing football at Georgia Tech. Specifically, the plaintiff remembers one instance where he was hit so hard during a kickoff that he suffered temporary, but complete, memory loss. The plaintiff believed he had returned to the sidelines on his own, and only after watching video footage of the play did he realize he was removed from the field.

Every time the plaintiff suffered a concussive or sub-concussive hit, he was denied the appropriate medical treatment. In fact, the plaintiff was often told to just “shake it off” and was put back in the game. As a result of his time playing college football for Georgia Tech, the plaintiff now suffers from significant memory issues, anxiety, mood swings, and other debilitating issues.

Evidence of the long-term effects of concussions has existed for decades, but despite this, the NCAA and ACC failed to properly educate student athletes on the long-term effects of concussions sustained during play. The NCAA and the ACC also failed to implement concussion treatment procedures and return to play protocols the NCAA knew were necessary to monitor, mitigate, and manage the effects of concussions.

The NCAA has a moral duty to act en loco parentis, or in the place of parents. Parents send their children to college assuming they will be safe and unharmed, however, student-athletes still have developing brains, so concussions sustained while playing football can cause permanent cognitive damage.
